The link between access to justice and legal services isn’t as strong as it has been in the past. Fees are creeping up year by year, which is stopping many people in their tracks; they therefore end up being stuck between a rock and a hard place, looking for that light at the end of the tunnel and seeing none in sight.

The world is changing quickly around us and we believe that the way people access legal help needs to change too and be all about the individual and never about the law firms. Only 8% of every 100 people who say that they need legal help actually seek help from a solicitor due the fact that they don’t find what they’re looking for at a price that makes sense to them.

Increasing costs and cuts in public funding are just two of the factors leading to an increase in the number of Litigants in Persons or Self Represented Litigants (“SRLs”) as they must now be known.

It seems clear that there will be increases in the number of litigants in person wanting to use the courts and requiring practical assistance. Any individual unable to afford professional representation is surely entitled to represent him or herself in court proceedings.

If a SRL decides that he will represent himself in litigation, he is entitled to have clear guidelines as to the way in which the system works and what is expected of him, be it in the preparation of his case or in his general conduct. Unfortunately this is no longer available as the budget cuts by the court service has removed many court staff who previously provided basic information to litigants in person.

When you first start out it’s a frustrating and frightening process with many not knowing who to turn to for help and advice. Many do not cope well with either the written or the spoken word. Many are unable to properly organise their paperwork.
